Just a question on the difference between Intellectual Property vs Trade Secret Law.
The description of both seem to be very similar and in some case I would suspect that both would exist in the same category from time to time.
In terms of questions that you might find related to these areas, is there anything you can look for that would very clearly delineate one from the other?
Thanks in advance everyone
Intellectual Property vs Trade Secret Law
The legal aspects of intellectual Property and Trade Secrets do tend to go hand in hand. Intellectual Property is the legal right of things people make or invent. Trade Secrets can therefore fall under Intellectual Property rights. Whereas in Intellectual Property, the owner of the intellectual property protect from a others claiming it belongs to them (overly simplistic). Trade Secrets Law bears not specifically because it's owned or created by me but that the value that I derive from the invention or process is based on the secrecy of my invention. This is the delineation that I would make.
This is overly simplistic, the legal ramifications are much more complex and I'm not a lawyer and shouldn't be making any claims to be so!
