If all workstations have Windows 7 x64 preinstalled - ( joined to domain)
are those machines eligible for the free MS windows 10 update program?

It was supposed to be free only up to a year from Windows 10 release date. But if you're still getting the notification that you can get the upgrade. I'm assuming it's still valid...but assumptions can only get you so far. So the only way to know is try it on one. Then see if it is still a valid and free offer.
Before you do so, make sure you back up the machine. That way, if it's not what you thought, you can always restore the backup.

Actually i wasn't clear..my query was whether it is legally allowed in terms of MS licensing - to mass update all domain joined workstations running windows 7
The workstations are purchased with pre-installed oem version of windows 7 (windows 8.1 downgraded) -
I would believe so. Since Windows really wants you to update. but be aware the time limit may have expired for you to do so...I cannot be sure of it.
